Terms of Use
The following Terms of Use apply to the Skills4Care Web
Site (the “Web Site”) and to the services, products,
resources, information, content, materials and results or
output derived from such services or products on the Web
Site (“Site Content”). By using the Web Site
or Site Contents you accept and agree to comply with the
following Terms of Use. Your use of certain resources made
available on the Web Site or the conduct of certain transactions
may be subject to certain additional terms and conditions,
which will be made available to you prior to using such
resources or conducting such transactions. We reserve the
right to
modify, alter, update, or remove portions of these Terms
of Use at any time, so please check these Terms of Use
(and our Privacy Policy) from time to time. Your continued
use
of the Web Site signifies your acceptance of any changed
items. If you do not agree with our Terms of Use, your
sole remedy is to discontinue your use of the Web Site.
The failure
of Skills4Care to enforce these Terms of Use, for whatever
reason, shall not be construed as a waiver of any right
to do so at any time.
Use of Content on the Site
You may view, download, and print
contents from the Web Site subject to the following conditions:
(a) the content may
be used solely for information purposes; and (b) the content
may not be modified or altered in any way. You may not
republish, distribute, prepare derivative works, or otherwise
use the
content other than as explicitly permitted herein.
Community Conduct
While using the Web Site or Site Contents, you are a part
of the Skills4Care community, and you agree that your use
will respect the rights of other members of the community.
In particular you agree not to: (1) restrict or inhibit any
other user from using the Web Site or Site Content or from
purchasing any products or services sold by Skills4Care;
or (2) submit, publish, distribute, or transmit through the
Web Site or its e-mail links materials that do not meet the
requirements of these Terms of Use; or (3) impersonate any
person or entity or forge anyone else's digital or manual
signature or attempt to gain unauthorized access to Skills4Care's
or any other person's computers, software or data.
We reserve the right to prohibit use of the Web Site or the
purchase of products and services from Skills4Care by any
user who, in our sole discretion, violates these Terms of
Use. Such a prohibition may occur without notice to the user.
If you believe another user is violating these terms, you
may notify Skills4Care, and we will work in good faith to
resolve any such issues. However, we have no obligation to
monitor the Web Site or Site Content and are not responsible
for the accuracy or reliability of any Site Content or opinion,
advice, or statement made on the Web Site, or for any defamatory,
offensive, or illegal conduct by any user of the Web Site.
Skills4Care reserves the right to
investigate suspected violations of these Terms of Use,
including the gathering of information
from the user or users involved and the complaining party,
if any, and examination of material on Skills4Care's servers
and network. You hereby authorize Skills4Care and its distribution
affiliates to cooperate with (i) law enforcement authorities
in the investigation of suspected criminal violations,
and (ii) system administrators at other Internet service
providers or other network or computing facilities in order
to enforce these Terms of Use. Such cooperation may include
Skills4Care providing the username, IP address, or other
identifying information.
Privacy Policy
Skills4Care is committed to protecting the privacy of our
online customers. This policy discloses the privacy practices
for the Skills4Care Web Site. We use the information we collect
about you from the Skills4Care Web Site to process orders
and to provide a more personalized experience as you use
the products and features of this Site. This policy explains
how your personal information is safeguarded and the use
we make of it in our business. This policy may change, so
please check back from time to time.
Information We Gather from You
We do not collect any personal information from a visitor
to our Site unless that visitor explicitly and intentionally
provides it. If you are simply browsing our Site, we do not
gather any personal information about you. There are three
ways in which you may explicitly and intentionally provide
us with and consent to our collection of certain personal

Registration - We ask for personal information from you when
you become a registered user of Skills4Care. The more information
you volunteer (and the more accurate it is), the better we
are able to customize your experience. If you choose to enroll
in one of our online courses or other services, we will request
certain information from you. Depending on the type of product
or service that you request, you may be asked to provide
different personal information. For certain products and
services, we may require your name, address, telephone number,
e-mail address, etc. Other products and services may require
different or supplemental information from you in order to
apply. For a detailed listing of the type of personal information
requested for our various products or services, please refer
to the enrollment page for the particular product or service.
E-mail Request for Information or Registrations
for Seminars or Services - We may use links throughout our Web Site to
provide you with the opportunity to contact us via e-mail
to ask questions, request information and materials, register
or sign up for seminars or services, or provide comments
and suggestions. You may also be offered the opportunity
to have one of our representatives contact you personally
to provide additional information about our products or services.
To do so, we may request additional personal information
from you, such as your name and telephone number, to help
us satisfy your request.
Surveys - Occasionally we may request information from customers
via surveys. Participation in these surveys is completely
voluntary and the user therefore has a choice whether or
not to disclose this information. Survey information will
be used for purposes of monitoring or improving the use of
and satisfaction with this Web Site, and improving our customer
service and product offerings.
What kinds of personal information does Skills4Care collect?
- You are required to register and receive a logon
name that enables you to take online classes, receive continuing
education
credits, view your transcript, and use certain other
features of the Skills4Care Web Site accessible only to
registered
users. To become a registered user you must provide
your name, e-mail address, and other information we need
to provide
access to learning content, award continuing education
credits, provide access to your transcript, etc.
- We also request certain other optional information
to enable us to provide our customers with a more personalized
experience
when using Skills4Care. This information is used
to identify broad demographic trends. In the course of
using our Site,
we may automatically track certain information about
you such as what type of browser you are using. We may
also monitor
customer traffic patterns and Site usage to help
us refine and improve the design and layout of our Skills4Care
Site
and the user experience. We compile and analyze this
information on an aggregate or anonymous basis. We collect
and report
only aggregate or anonymous information to our advertisers.
- If you send us personal correspondence, such
as e-mails or letters, we may keep a record of that correspondence.

also periodically ask users for feedback that we
use to improve our service and products and add new features.

- In order to award continuing education units
(CEUs), we must collect and report certain information
for each course completion.
Information of your course completions including
your name, professional licensure(s), course completion
date, course
title, and number of continuing education units awarded,
is reported to the appropriate professional licensure
organizations based on the license information you supply
to Skills4Care
through the user registration process, and via personal
profile pages.
How does Skills4Care use my information?
- The personal information you provide allows Skills4Care
to facilitate the support, renewal, and purchase of our
products
and services and notify you of the status of your user
account.
- We collect personal information to give you a
customized experience and to help Skills4Care understand
its customers
better. Skills4Care does not sell, trade, or rent
your personal information to others. Skills4Care
may choose to offer communications such as newsletters,
promotions or correspondence from third parties that are
made available to Skills4Care customers at their request
on an opt-in/opt-out basis.
- We may, from time to time, use the information
we collect to notify you about important functionality
changes to the
Web Site, up-to-date information about new Skills4Care
services and products, and special offers we think you
will find valuable.
Does Skills4Care share my information?
Other than as stated in this policy, Skills4Care does

parties may gather information about you. The Skills4Care

policy does not cover the practices of those businesses.
Business partners and sponsors
Many promotions give you the chance to request additional
information from the sponsors. When you ask for more information,
you give Skills4Care permission to send your personal information
to the sponsor so they can fulfill your request. Much of
the time, only your e-mail address will be shared. You
will be notified if more information will be shared, and
you can
choose not to share the information. When you enroll to
obtain a product or service from a sponsor on the Site,
you accept
the specific agreement applicable to that product or service.
Your use of any such product or service offered on the
Site is governed by the terms and conditions in the agreement
for that product or service.
Third-party data and aggregate data
Skills4Care discloses aggregated or anonymous statistics
(for example, the percentage of users from the western
U.S.) to prospective partners and advertisers and for other
lawful
purposes.

Skills4Care also may disclose your information where
disclosure is necessary to identify, contact, or bring
legal action
against someone who may be causing injury to or interference
with our rights or property rights, the users' rights,
or others’ rights. In the same way, Skills4Care
will disclose information when we reasonably believe
disclosure is required
by law or to comply with a legal process served on
Skills4Care or its Web Site. We may disclose your personal

in the good faith belief that we must act under exigent
circumstances to protect the personal safety of users
of Skills4Care, its

What security precautions does Skills4Care take to protect
me?
- Your Skills4Care account information and profile are
password-protected so that you are the only one who has
access to your personal
information. You can edit your account information
and profile by using your logon name and password.

you follow these guidelines to protect yourself:
- Do not tell anyone your password. If your password
has been compromised for any reason, you should
immediately change
your password.

How does Skills4Care protect my credit
card and financial information?
We are committed to protecting the privacy of your credit
card and financial account information. When you enter
credit card information on our Web Site, we transmit
the information
in encrypted format, using industry standard, secure
socket layer (SSL) encryption. We will not disclose that
you purchased
a specific product, but we might disclose statistics
on how many customers have purchased a specific product.

or that any errors will be corrected; (3) any particular
results will be obtained from the use of the Web Site

Refund Policy
Within 30 days of your initial purchase of a
course or subscription from Skills4Care, you
may request
a full
refund, provided
that you have not yet been granted Skills4Care
Continuing Education Credits for the course
or subscription.
Beyond the first 30 days, no refunds are issued
for Skills4Care
courses or subscriptions.
Links to Third Party Web Sites and Information
The Skills4Care Site may provide hyperlinks
to third party web sites or access to third
party
content.
Skills4Care does not control, endorse,
or guarantee content found
in
such
sites. You agree that Skills4Care is not
responsible for any content, associated links, resources,
or services associated
with a third party site. You further agree
that Skills4Care shall not be liable for
any
loss
or damage of any
sort associated with your use of third
party content. Links
and access to
these sites are provided for your convenience

Indemnity
You agree to indemnify, defend, and hold
harmless Skills4Care and its officers,
